• What is a trademark?

  A trademark is your brand name with or without logo to distinguish product or services you deal in. Trademark can be word, letter, number, phrase, symbol, shape or combination thereof. A trademark/ brand name or logo is used to distinguish your product/service from those existing in the industry. An applicaiton needs to be filed to obtain a registered trademark.

• When can i start using my Trademark?

On receiving ™ Application number one can start using the trademark or brand/ logo applied for.

• Can all the trademarks be registered?

  No. Only those trademarks which are not identical or meant to defeat the purpose of an existing registered trademark or the one which has been applied for registration can be registered. It is important to note that name of trademark should not be likely to cause deception or confusion in the eyes of consumers and should not be offensive. Generally, geographical names, industry names, names prohibited by Government and common abbreviation are not registered as a Trademark.

• What are the benefits of having a Trademark?

  Having a registered trademark provides your business with number of benefits:

  It is always suggeted to register a trademark on or before starting a business.

• Does a trademark registered in India valid in other countries? 

  No, a trademark registered with Indian Trademark Office is valid in territory of Indian nation only.

• What is the validity of Trademark registration?

  A registered trademark is valid for 10 years from the date of filing of application. Post that an applicaiton for renewal has ot be filed.

• How do I coordinate with the logo designer?

  Your Teller will co-ordinate with the designer and provide you with the best of the designs. 

• What is the expected time taken in providing sample logo ?

  We generally provide a sample of your logo within 2 working days. Post that 1 more day is taken to finalise after your approval.

• Does this package involvesresolving objections rised by Trademark authorities?

No, replying to trademark objection involves legal draftings and additional time by Trademark specialist. Accordingly, separate package needs to be purchased post discussion with your Teller.
